Storyzen Terms of Use
These Terms of Use ('Terms') govern your access to and usage of the Storyzen website, and APIs ('Storyzen' or the 'Platform'). The terms 'we,' 'us,' and 'our' refer to Storyzen. The term 'you' refers to you, as a user of our Platform. Please carefully read through these terms and send us an email (via support@storyzen.co) regarding any questions you might have.
1. Using Storyzen
You may use our Platform only if you agree to our Terms of Use and Privacy policy, and only in compliance with these Terms and all applicable laws. When you create an account with us, you must provide us with factual and up-to-date information regarding yourself or the commercial, governmental, or non-governmental organization or entity you represent. Usage of our Platform by individuals under the age of 16 is not allowed. If you are accepting these Terms and using the Platform on behalf of a commercial, governmental, or non-governmental organization or entity, then 'you' as used in this document covers you and that organization or entity, and you represent and warrant that you are authorized to grant the permissions and licenses provided in these Terms and bind the organization or entity to these Terms, and that you agree to these Terms on the entity's behalf. You may use the Platform only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations.
Your use of our Platform is subject to our terms and conditions set out herein, and by using our Platform you are agreeing, and you are signifying your agreement, to be bound by these terms and conditions. You are also responsible for ensuring that all persons who access our Platform through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.
Every effort is made to keep our Platform up and running smoothly. However, Storyzen takes no responsibility for, and will not be liable for, the Platform being temporarily unavailable due to technical issues beyond our control.
Our license to you
Subject to these Terms and our Privacy Policy, we grant you a global, nonexclusive, nontransferable, revocable, limited license to use our Platform.
2. About Storyzen
Storyzen is an AI-based Short Story Generation website. In accordance with prevailing laws, all content generated by Artificial Intelligence programs including all stories generated using the Storyzen.co AI Language Model, are copyright-free.
3. Generated Content
All content that you share on, or otherwise make available on Storyzen, is henceforth referred to as 'Generated Content'.
By sharing any Generated Content to Storyzen, you grant Storyzen and our Users and Members a non-exclusive, royalty-free, transferrable, sublicensable, worldwide license to use, store, display, reproduce, share, re-share, modify, create derivative works, perform, and distribute your Generated Content solely for the purpose of operating, developing, providing, and using the Storyzen Platform. Nothing in these Terms shall restrict other legal rights Storyzen may have to your Generated Content, for example under other licenses. We reserve the right to remove or modify your Generated Content for any reason, including Generated Content that we believe violates these Terms or any of our other policies. You also give permission to Storyzen to add, modify or remove information related to your Generated Content in order to manage and license such Generated Content if required, in accordance with applicable laws.
By sharing any Generated Content to Storyzen, you grant Storyzen a worldwide, non-exclusive right to use your Username and the Shared Generated Content in connection with Storyzen's marketing and promotional activities without the payment of any compensation to you. Storyzen, in the exercise of its discretion, may refrain from any or all of the foregoing without any liability to you.
4. Regarding Prohibited Content
Any inappropriate Generated Content, including but not limited to: content that violates any laws, content that incites hatred or violence towards any country/race/religion/gender/sexual orientation, sex themed content, and content that features other inappropriate material will be deleted. Any User Account that is used to share inappropriate Generated Content will be shut down.
5. Regarding Links to Third-Party Sites and Services
Storyzen may feature adverts and promoted content that include links back to third-party websites. Accessing a third-party website is at your own risk and we bear no liability arising from access, use, or misuse of a third-party site or service.
6. Copyright Policy
Storyzen respects the intellectual property rights of others and we expect all users on Storyzen to do the same. We will teminate the account of any user who repeatedly infringes or who is repeatedly charged with infringing copyrights or other intellectual property rights.
We respond promptly to all claims of copyright infringement on Storyzen. If you’re a copyright owner or authorized to act on behalf of one, you can report alleged copyright infringements on Storyzen by contacting us via email at: copyright@storyzen.co.
When we get your Copyright Infringement notice, we’ll take whatever action we deem appropriate, which may include removing the reported content from Storyzen .
If we remove Generated Content in response to a Copyright Infringement notice, we may notify the individual or entity who shared the Generated Content on Storyzen so that he/she have the opportunity to send a counter-notice.
7. Security
We care about the security of our Users. While we work hard to protect the security of your account, We cannot guarantee that unauthorized third parties will not be able to defeat our security measures. You bear the responsibility for maintaining the confidentiality of any password associated with your Storyzen account, and assume full responsibility for all activities that occur within your account (unless we inadvertently cause a security breach). Please notify us immediately of any suspected unauthorized usage or compromise of your account.
8. Rights to Intellectual Property
The Storyzen Website (the 'Platform') is owned by Storyzen. All rights to, interest in, and title to the trademarks, service marks, and trade names displayed on the Platform, are the property of Storyzen, and are protected by copyrights, trademarks, patents, or other proprietary rights and laws.
All trademarks, service marks, logos and designs used on the Platform, whether registered or unregistered, are owned by Storyzen or other third parties. You may not use or display any trademarks, service marks, logos or designs owned by Storyzen or other concerned third parties without prior written consent.
9. On Termination of an Account
Storyzen reserves the right to terminate, immediately and without notice, any account that violates any of our Terms of Use.
10. Indemnnity
By registering on the Storyzen website, you agree to release and hold harmless Storyzen and its owners, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your usage of our Platform, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of our Platform; (v) electronic or human error which may occur in the administration of our Platform.
General Terms
11. A. Waiver and Severability
The failure of Storyzen to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
12. Transfer or Assignment of Terms
Storyzen may transfer assign these Terms and any rights and licenses granted, to a subsidiary or business successor. You may not transfer or assign these Terms and any rights and licenses granted, without the prior written consent of Storyzen, which shall not be unreasonably withheld. In case of any transfer or assignment by Storyzen, we will provide you with reasonable notice in advance of any such assignment.
If you’re located in the EEA, you may assign this agreement, and any rights and licences granted under it, to a third party.
13. Governing Law and Jurisdiction
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the the laws of the Republic of South Africa, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of accessing or using the Storyzen.co website, you hereby agree that any and all disputes which cannot be resolved between you and Storyzen, and causes of action arising out of or connected with this Platform, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the Republic of South Africa having jurisdiction. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than your actual out-of-pocket expenses (i.e. costs associated with using the Storyzen Platform), and you further waive all rights to have damages multiplied or increased. Nothing in this clause shall limit the right of Storyzen to take proceedings against individuals who violate these Terms in any other court of competent jurisdiction, nor shall the taking of proceedings in any one or more jurisdictions preclude the taking of proceedings in any other jurisdictions, whether concurrently or not, to the extent permitted by the law of such other jurisdiction.
14. Entire Agreement
These Terms together with our Privacy Policy, and any amendments are the entire and exclusive agreement between Storyzen and you regarding our Platform, and these Terms supersede and replace any prior agreements between Storyzen and you regarding the Platform.
We may revise these Terms from time to time, and we will notify you of changes to these Terms which we in our sole discretion believe to be significant and material by posting a notice on the account page of every Storyzen.co user. By continuing to access or use the Platform after those revisions become effective, you agree to be bound by the revised Terms.
